These Terms & Conditions ("Terms") govern your use of the MobCater App (including our Progressive Web App), mobcater.com, mobcater.co.uk, and all related tools, calculators, guides, services and content ("App"). By accessing or using the App, you agree to these Terms. If you do not agree, you must not use the App.
1. Definitions
"MobCater", "we", "us", "our": Selah Ltd t/a MobCater.
"App": the MobCater App (PWA or native), mobcater.com, mobcater.co.uk, and all associated digital tools and content.
"User", "you", "your": any individual or business accessing or using the App.
"Free Plan": basic access tier with limited free features.
"Premium Subscription": recurring paid plans (e.g., £5.99/month, £11.99/month).
"Annual Discount Pass": annual subscription (£99/year) providing access to all Business-Ready features plus members-only equipment discounts.
"Content": all text, guides, calculators, videos, tools, images, designs and other materials provided by MobCater.
2. Eligibility
2.1 You must be at least 18 years old.
2.2 You confirm that:
- you are 18+;
- you can enter legally binding contracts;
- you are using the App for business or trade purposes.
3. Acceptable Use Policy (NEW)
You must NOT:
- misuse the App or attempt to disrupt its operation;
- attempt to gain unauthorised access to systems, accounts or data;
- use the App for unlawful, fraudulent or harmful purposes;
- copy, scrape or extract data or content without permission;
- upload viruses, malicious code or attempt hacking;
- share login details or allow others to access your account;
- use automation (bots, scripts) to access features.
We may suspend or terminate accounts involved in prohibited activity.
4. Free Plan
4.1 Free Plan users receive limited access.
4.2 MobCater may update or withdraw Free Plan features without notice.
5. Premium Subscriptions
5.1 Plans
Examples:
- £5.99/month – Business Toolkit
- £11.99/month – Premium
Features may be updated from time to time.
5.2 Billing & Auto-Renewal
- Billed in advance
- Auto-renews unless cancelled
- Purchases made through Apple/Google follow their billing terms
5.3 Cancellation
- Cancel any time via account settings or app store
- No refunds for completed billing periods
- Access continues until the period ends
5.4 Price Changes
We may update subscription prices. If required by law, we will notify users before changes apply.
6. Annual Discount Pass
6.1 Annual subscription (£99/year) providing:
- All Business-Ready features for one year
- Access to members-only equipment discounts
- Automatic renewal unless cancelled
6.2 14-day money-back guarantee from purchase date.
6.3 After 14 days, non-refundable except where required by UK law.
7. Discount Offers
7.1 General Terms
- Discounts apply only to selected items
- Example savings (£40–£150+) are not guaranteed
- Discounts and suppliers may change or be withdrawn
- MobCater does not guarantee availability of any supplier or product
- Third-party suppliers fulfil orders; MobCater is not responsible for their service or products
7.2 Personal Use Only
- Discount codes and offers are for your personal use only and are non-transferable
- You must not share, distribute, resell, or publish discount codes with anyone outside your account
- Each discount code may only be used by the registered account holder
7.3 Verification & Enforcement
- MobCater reserves the right to verify account details and cross-reference discount code usage before, during, or after redemption
- We may request proof of identity or account ownership before processing orders with discount codes
- Suppliers may also verify that discount codes are being used by authorised MobCater members
⚠️ Abuse of Discount Codes
Sharing, reselling, or misusing discount codes may result in immediate account suspension, loss of Annual Discount Pass benefits, and forfeiture of any remaining subscription period without refund. MobCater reserves the right to void any orders placed using fraudulently obtained or shared codes.
8. Payments & Billing
- Payments processed via Stripe, Apple or Google
- Prices in GBP, VAT may apply
- Failed payments may suspend access
- You must keep billing details up to date
9. Refunds
- Monthly subscription payments are non-refundable unless required by UK law
- Annual Discount Pass: 14-day money-back guarantee, non-refundable after
- Billing issues must be raised within 30 days
10. Cooling-Off Period for Digital Content (UK Legal Requirement)
By accessing Premium or Annual Discount Pass content immediately after purchase, you agree that your 14-day cooling-off period ends upon access, under the Consumer Contracts Regulations 2013.
If you wish to retain the 14 days, do not access the digital content.
11. Account Responsibilities
11.1 Security
- You must keep login details secure
- You are responsible for actions taken using your account
- Do not share or resell access
- MobCater may suspend accounts for misuse or breaches
11.2 Account Deletion
- You may delete your account at any time via Settings → Delete Account
- This permanently removes your data, uploaded documents, and cancels any active subscription
- Deleted data cannot be recovered
11.3 User-Uploaded Content
- Documents you upload remain your property
- MobCater stores them securely and deletes them upon account deletion
- We do not access your documents except for technical support when requested by you
- You are responsible for ensuring uploaded content complies with applicable laws
11.4 Document Wallet - Important Notice
- The Document Wallet is designed as a convenient reference tool for storing copies of business documents
- Documents are stored securely using industry-standard cloud storage (AWS S3) with access controls
- While we implement reasonable security measures, the Document Wallet is not designed as a bank-grade secure vault
- For highly sensitive original documents (passports, identity documents), we recommend using a dedicated secure vault service in addition to MobCater
- You are responsible for maintaining your own backups of important documents
- MobCater is not liable for any loss, damage, or unauthorised access to uploaded documents beyond our reasonable control
12. Termination & Suspension (NEW)
MobCater may suspend or terminate your account if:
- you breach these Terms;
- you misuse or attempt to misuse the App;
- payment fails repeatedly;
- fraudulent or harmful activity is suspected.
Upon termination, access to Premium features or the Annual Discount Pass will stop.
13. Third-Party Links & External Services
The App may contain links to third-party websites or services.
MobCater is not responsible for:
- their content, accuracy or availability;
- any products or services offered by third parties;
- damages or losses arising from use of third-party sites.
Use third-party links at your own risk.
14. Service Availability & Changes
- We may update, modify or discontinue features at any time
- We do not guarantee uninterrupted access
- Planned maintenance may temporarily interrupt service
15. App Store / Google Play Disclaimer
If downloaded via Apple/Google:
- These platforms are not responsible for the App's content or performance
- They are not involved in providing refunds or support
- All support must be directed to MobCater
16. Intellectual Property
- All content is owned by or licensed to MobCater
- You may use content only for business reference
- You must not copy, modify, redistribute or reverse engineer the App
17. Professional Advice & Calculator Disclaimer
All information, guides, and calculators provided by MobCater are for general guidance and illustrative purposes only.
Specifically regarding our calculators:
- The Startup Cost Calculator provides estimated ranges based on typical industry figures - actual costs may vary significantly
- The Menu Pricing Calculator offers general pricing guidance - you must verify margins suit your specific circumstances
- The Generator Calculator provides approximate power requirements - always consult a qualified electrician for final specifications
- The Break-Even Calculator uses simplified assumptions - seek professional accountancy advice for business decisions
- All financial figures are estimates and should not be relied upon for investment or lending purposes
MobCater does not provide professional engineering, electrical, gas, financial, legal or accountancy advice.
Always consult appropriately qualified professionals before making business decisions or undertaking installations.
18. Engineer Directory Disclaimer
- Engineers listed are independent
- MobCater does not verify or endorse qualifications
- You must verify competence, Gas Safe registration and insurance
- MobCater is not liable for third-party work
19. Liability
MobCater is not liable for:
- indirect or consequential losses
- installation errors
- third-party services
- reliance on calculators or guides
Nothing excludes liability for:
- death or personal injury caused by negligence
- fraud
- rights that cannot be excluded by law
20. Force Majeure
MobCater shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- acts of God, natural disasters, or severe weather
- pandemic, epidemic, or public health emergency
- war, terrorism, civil unrest, or government action
- failure of third-party hosting, cloud services, or internet infrastructure
- cyber-attacks, hacking, or malicious interference
- power outages or telecommunications failures
- industrial action or labour disputes
During such events, our obligations shall be suspended for the duration of the event. We shall use reasonable endeavours to resume normal service as soon as practicable.
21. Indemnification
You agree to indemnify, defend, and hold harmless MobCater, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
- your use of the App in breach of these Terms
- your violation of any applicable law or regulation
- any content you upload, including documents containing unlawful material
- your negligence or wilful misconduct
- any claim by a third party arising from your use of the App
This indemnity shall survive the termination of your account and these Terms.
22. Privacy Policy & Cookie Policy
Use of our App is also governed by:

By using the App, you agree to them.
23. Changes to These Terms
We may update these Terms from time to time.
For significant changes, we will notify users via:
- in-app notice
- website notice
Continued use of the App after changes take effect constitutes acceptance.
24. Severability
If any part of these Terms is found unenforceable, the remaining sections remain valid.
25. Entire Agreement
These Terms, together with the Privacy Policy and Cookie Policy, make up the entire agreement between you and MobCater.
26. Governing Law
These Terms are governed by the laws of England & Wales.
Courts of England & Wales have exclusive jurisdiction.
